Children’s Miracle Network., Best Buy, Landing Zone and their subsidiaries and affiliated companies (together, the Companies), will conduct this tournament substantially as described in these Tournament Rules, and by participating, each participant agrees as follows:

Note: The registration form and the consent forms need to be signed and turned in before you are allowed to play in the event. If you are under the age of 18 the consent must be signed by a parent/guardian. Copies of these forms are available below for printout. Copies of the consent forms are also available at Utah Best Buy stores and at the registration table the day of the event.

1. Eligibility and Limitations

The event is open to any and all players who feel confident enough to compete in a competitive gaming tournament with the following limitations: Participants and winner(s) must be U.S. residents. Only one (1) prize per participant per event. Only one (1) prize per participant within any thirty (30) day period or ninety (90) day period for any prize valued over $500. Employees of Children’s Miracle Network., Best Buy, Landing Zone, their volunteers, sponsors and their advertising agencies and members of the immediate family of any such persons are not eligible to participate and win. RedOctane and Activision employees are also prohibited from tournament participation. The term “immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws,” or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related.

All Competitors MUST have signed registration forms in hand day of the event in order to participate. Competitors who fail to provide the proper signed forms will not be permitted to compete. All forms will be available at registration at 11am on the day of the event and are also available for printout below.

2. Publicity; Use of Personal Information

By participating, where allowed by law, all participants and winner(s) grant the Companies exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with promotion of this and other contests and waive any claims to royalties or remuneration for such use. By participating in the Tournament, where allowed by law, participants agree that the Companies may disclose personal information obtained from participants in the Tournament to third parties and use such information for marketing and other purposes.

3. Release

By participating in the Tournament, each participant and winner waives any and all claims of liability against the Companies, it employees and agents, the Tournament’s sponsors and their respective employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Tournament, or from the use of any prize. In order to receive a prize, participants must sign an official waiver form provided by the Companies.

4. Taxes

Any valuation of the prize(s) stated above is based on available information provided to the Companies, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Each winner is solely responsible for reporting and paying any and all applicable taxes related to the prize(s) and paying any expenses associated with any prizes which are not specifically provided for in the official rules. Each winner must provide the Companies with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded. Any person winning over $600 in prizes from the Companies will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.

5. Registration

Online registration will be available at www.landingzonegaming.com beginning 4/21/08. Registration will be open at 11am on the day of each event and will be open until the end of the tournament or until all slots have been filled. Registration will operate on a first come first serve basis. The first 342 competitors to complete the registration process will be confirmed to compete and at that time, registration will close.

All competitors under the age of 18 must have a signed parental consent form to compete. Landing Zone recognizes the standards established by the Entertainment Software Rating Board for videogames. In observation of these standards, the Guitar Hero 3 tournament is restricted to competitors 13 years of age or older unless a parent has signed a parental consent form and initialed the clause allowing a competitor younger than 13 to compete. It is at the parents’ discretion to allow a competitor who is under the age of 13 to compete.

6. Tournament Structure

At the time of registration, each competitor will be given a wristband in the color of their chosen difficulty level. 10 minutes prior to the competitors scheduled time, they are to report to an admin in the area of their console. Failure to be at the designated console area at the scheduled time could result in a forfeit.

Competitors will chose at the time of registration the difficulty bracket they wish to compete in (Medium, Hard or Expert). Competitors will then be paired with another competitor in the same difficulty bracket and given a time and a station number to be near in the tournament area to compete. Two songs from the below song list will be chosen at random for the competitors to perform. Both competitors will perform those songs with the game in Pro Face-Off mode. After each song is played in Pro Face-Off mode, their score for there songs will be added together for a final score. The current top five scores for each bracket will be posted on a leader board. At the end of each song, the competitors must keep the Song Result Screen onscreen until an attendant has documented the scores. Failure to do so will result in a zero score for the competitor who deleted the screen. The other competitor will be allowed to replay the song.

When the competitor has finished competing, the wristband will be removed from their wrist and kept by the admin.

Experts will play a second round consisting of three songs chosen at the time of the tournament.

7. Tournament Preparation

Competitors are encouraged to practice the following 3 songs prior to participating in this event. Be prepared to play these 3 songs to the best of your ability, There will be no consoles available for warm-ups prior to competing.

It is the responsibility of the competitors to know how to play Guitar Hero III. The Companies are not required to provide How-To-Play instructions nor will the Event Admin instruct competitors on how to use the console or how to better their score.

8. Songs

Three song will be announced later today oct. 6th.

9. Console and Game Settings

Competitors may choose right or left handed mode. No cheats will be allowed to boost scores, nor will the use of objects external to the controller (i.e. rubber bands, ect.) be allowed.

10. Schedules

All competitors will be provided a competition time at the time of registration. This time will be written on the competitor’s wrist band. Competitors must be in the Tournament area 10 minutes before their scheduled competition time. Forfeits may be issued to any competitor who is not at their console at their scheduled time.

12. Cheating and Rule Violations

There will be absolutely no form of cheating tolerated at this event. If a competitor is caught cheating they will be immediately disqualified and removed from the Tournament Area. Any violation of the Tournament rules will result in immediate removal from the Tournament Area and elimination from tournament participation.

13. Procedures

All competitors must have permission from a Tournament admin in order to enter the tournament area. Please be sure to check in with an Admin before entering designated areas. Competitors must remain in the tournament area until scoring is complete. Leaving the area before a completed set will result in a disqualification.

14. Tournament Conduct and Decisions

By participating in the Tournament, competitors agree to be bound by the decisions of the personnel of the Companies. Persons who violate any rule, gain unfair advantage in participating in the Tournament, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. All scores are final, negative remarks to the admin or personnel of the Companies will not be tolerated. The Companies will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Tournament and the Companies’ decisions concerning such disputes will be final. If the conduct or outcome of the Tournament is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Companies, the Companies reserve the right to terminate the Tournament, or make such other decisions regarding the outcome as the Companies deem appropriate. All decisions will be made by the Companies and are final. The Companies may waive any of these rules in its sole discretion. ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS TOURNAMENT, TELEPHONE SYSTEMS OR WEBSITES, OR UNDERMINE THE LEGITIMATE OPERATION OF THE TOURNAMENT IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE COMPANIES RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.

15. Liability

All Competitors and Spectators are responsible for one's self and property.

WARNING: If you have heart, respiratory, or other physical impairments that limit your physical activity, DO NOT use the Guitar Hero Les Paul Controller. If you have any doubts, consult with a physician before using the Guitar Hero Les Paul Controller.

• The Guitar Hero Les Paul Controller must be used with care to avoid injury. RedOctane /Landing Zone will not be liable from injuries resulting from improper use of the Guitar Hero Les Paul Controller.

• Small children should be monitored at all times when using the Guitar Hero Les Paul Controller.

• Do not modify or disassemble the Guitar Hero Les Paul Controller under any circumstances.

16. Miscellaneous

Void where prohibited. Odd of winning depend upon the number of participants. Each winner must submit proof of eligibility and sign the Companies release form to claim the prize. The Companies may substitute prizes, amend the rules or discontinue the Tournament at any time. The Companies disclaim any responsibility to notify participants of any aspect related to the conduct of the Tournament. For a copy of the rules, or where required by law, a list of winners, visit the business office of the Z100 radio station during normal business hours or visit the Station’s website. All entries to become the property of the Companies and will not be returned.

17. Compliance with Law

The conduct of the Tournament is governed by the applicable laws of the United States of America, which take precedence over any rule to the contrary herein. The Companies shall follow the applicable laws for conducting contests, including notice to the state attorney general or consumer affairs office, posting of a prize bond, furnishing lists of winners, running specific on-air disclaimers, providing specific written information about the Tournament, etc. as required by local and state laws.
